They confirm 22 years to an abuser whose ex-partner was released by the GEO in front of his children

The Supreme Court (TS) has confirmed the sentence of 22 years and eight months in prison for a man who kept his ex-partner with their two children for five hours held in his apartment in Leganés while he mistreated her, threatened her with death and tried to stab her , until it was released by the GEOs.

The Criminal Chamber of the high court has issued a ruling in which it dismisses the appeal of the convicted against the resolution of the Superior Court of Justice of Madrid (TSJM), which ratified that of the Madrid Court.

The first instance sentence sentenced him to 22 years and 8 months in prison for two crimes of serious threats, another of injuries, three of illegal detention and a minor crime of damages.

In addition, it imposed compensation on the woman of 19,551 euros, set a maximum sentence of 17 years in prison and established that after serving three quarters of the sentence or once she reaches the third degree, she will be expelled from the country with prohibition to return to Spain within a period of 10 years, the only aspect modified by the TSJ of Madrid, which revoked.

The accused and his ex-partner began a romantic relationship in March 2018 when she rented him a room in her house in Leganés where she lived with her two children, although the relationship ended in June 2019, so that the accused left the home.

A few months later, on October 14, 2019, the accused broke into the building around 07:00 and approached the woman and her partner at the elevator door with a knife and a gun and told them that he was going to kill them.

He immediately grabbed the woman by the hair and slashed at the couple who intervened to prevent him from taking the woman, and who was able to dodge, although he immediately left the place.

Immediately afterwards, the condemned man put the woman in the house, pulling her, closing the door and blocking it with a piece of furniture, knowing that the children were inside the house.

Once inside, he began to stab at her, which they stopped with their arms, and while this was happening, the children came out of their rooms to the sound of screaming.

He told one of them to call his uncle to tell him that he had his sister and that he was going to kill her, showing the state she was in at that time.

The violence did not stop. Hair pulling, kicking, stomping until he took her to the bedroom where he tried to stab her again, while the children were locked in the bathroom and came out from time to time to ask the defendant to stop hurting their mother, although they immediately returned because the condemned man pointed the gun at them so that they would do so.

When the agents arrived, the accused, far from releasing the people, took the woman to the terrace where he ordered her to take off her pants, telling her "if you've fucked the other, you're also going to fuck with me", putting his hand of her through the inside of her swimsuit. Right there, one of the children came out of the bathroom to tell his mother not to tell the accused no to anything.

Later, the Police entered the house and there found the accused entrenched behind the body of the victim, who was on her knees in front of him, but with her back turned towards the agents, placing the knife on her neck and pointing it at her. the gun to her head, with which he lightly hit her on one occasion, telling her several times that he was going to kill her, that he had nothing to lose.

This situation lasted until noon and just when it started to rain, the woman fell to the ground and a member of the GEO took advantage of the defendant's distraction to shoot him with a taser gun, a shock that managed to immobilize him and stop him.

The condemned man argued before the Supreme Court that he was drug addicted, but the expert reports rule it out and even the woman said that when they lived together he only drank tea, in the same way that the Supreme Court rejects the argument that he did not know anything about the children or acted against them since "the deprivation of liberty was carried out with knowledge and will."
