They ask the prosecutor to desist from accusation against Salvadoran woman processed by abortion

The organization The 17 El Salvador on Friday asked the attorney general, Raul Melara, to "order" his assistants "desist" from the accusation against the young Evelyn Hernandez, to whom the Public Prosecutor imputes the crime of aggravated homicide committed to supposedly abort .

Hernandez, 21, will face a trial on Monday in which the Court of Judgment of Cojuteque will decide if she is sent to prison or is acquitted of the crime attributed to her.

The date of this procedure has been changed four times for various reasons, which, according to several organizations that fight for the decriminalization of abortion in the country, is a "serious" violation of the girl's human rights.

Hernandez, who was put on probation last February, was sentenced in July 2017 to 30 years in prison for the crime of aggravated homicide, but in December 2018 the Criminal Chamber of the Supreme Court of Justice (CSJ) annulled the ruling issued by the Court of Judgment of Cojuteque and ratified by the First Criminal Chamber of the First Section of the Center of San Salvador.

Before this, said chamber ordered the sentencing court to hold a new trial against the woman, who, according to her lawyers, suffered an "out-of-hospital" delivery on April 6, 2016.

In El Salvador, women who suffer pregnancy complications resulting in spontaneous abortions and stillbirths are usually suspected of having undergone an abortion, prohibited under all circumstances and classified as aggravated homicide, whose prison term is 30 years.

Since 2009, the Citizen Group for the Decriminalization of Abortion has managed to get 28 women, accused of abortion, to recover their freedom. One of the most emblematic cases is that of Teodora del Carmen Vásquez, who was sentenced to 30 years in prison for an abortion that was not proven.
