Las Palmas de Gran Canaria, Oct 1 (EFE) .- The prosecutor will ask in the jury trial that will begin on Monday at the Las Palmas Hearing one year and nine months in jail for the former director of Infecar Rafael Suárez and the head of the company Hérgora Catering SL, Carlos Orce, for an alleged misappropriation of 3,500 euros.
According to the brief of provisional conclusions of the Public Ministry, the two defendants in this case, known as the “Infecar case”, intervened, in December 2011, in the preparation of the bill for a food and beverage supply service carried out in the 9th Autonomous Congress of the Centro Canario Nacionalista (CCN), which took place on the 17th and 18th of that month at the facilities of the Institución Ferial de Canarias.
The prosecutor assures that the amount of this service was 3,500 euros and that, when making the invoice, “by indication of the acting director and director of the area of fairs and events of Infecar, Rafael Suárez”, the person in charge of the company that lent, Carlos Orce, made it appear as a “children’s healthy cooking workshop, knowing that this did not correspond to reality.”
All this reported a benefit to the CCN, “which did not pay any amount for said service” for the provision of food and drink, “thus receiving a favorable treatment.”
Considering that these facts, for which the two defendants are responsible, constitute a crime of embezzlement of public funds, the prosecutor requests a fine of 6,000 euros, one year and nine months in prison and three years of suspension of employment or public office, respectively.
In terms of civil liability, it is in the interest of both defendants to compensate Infecar with 3,500 euros, and it holds the CCN liable as a profit-sharing participant and Hergora Catering SL as a subsidiary civil liability. EFE
