The Treasury will use 70 data sources to monitor “fictitious” addresses abroad to pay less taxes

The general director of the Tax Agency (AEAT), Jesús Gascón, has advanced this Tuesday that the body will have up to 70 different data sources to cross through ‘big data’ techniques to check fictitious taxpayer relocations and check if they really reside abroad. In addition, it expects to be able to resume visits with “full legal guarantees” throughout 2021.

This has been indicated during his appearance before the Finance Commission at his own request to report on the Tax and Customs Control Plan of 2021, in which he stressed that ‘big data’ techniques allow a “more generalized” application in the scope of asset analysis and, consequently, to further detect fictitious relocations of taxpayers to other territories.

Gascón has pointed out that the issue of relocations “has become fashionable lately”, after the controversy over the departure of some ‘youtubers’ and ‘influencers’ to Andorra and other territories with a lower taxation.

In this sense, it has specified that there are currently 2.5 million Spaniards living outside the country, a fact that “must be considered good” as it is generally true, although “fictitious relocations” also occur. On your side, there are about 5 million foreigners residing in Spain.

Faced with the “chaos” of relocations, he has valued the “progress” that involves combining 70 different data sources with the ‘big data’ technique in cases of evidence, which has led him to affirm that the data “is greater than what have never been “in order to have evidence of a possible fictitious relocation.

Then, he added, it will be possible to undertake a probative action and, if necessary, open a file, although he has recognized that these are “complicated” procedures, since “one thing is that you have evidence and another is that you are capable to prove it. ”

In any case, it believes that the combination of sources, some structured and other information obtained from open sources, is “absolutely crucial” because the evidentiary processes are “very complicated. In this matter, the central coordinating control has” much to say. ” of relevant assets, Gascón pointed out.

In the field of control, Gascón has indicated that it is necessary to regularize defaults and obtain the collection of debts, promoting voluntary compliance, in a context in which the “extraordinarily important” challenge of managing rates for the first time will have to be assumed ‘ Google ‘and’ Tobin ‘and delve into control of the digital world.

Visits paralyzed by the pandemic

The general director of the AEAT has also affirmed that the organization plans to carry out a “good number of visits”, although the plan has been suspended until the health situation improves.

Among the visits, he has indicated that those of “greater intensity” are the entrances with judicial authorization into “constitutionally protected” homes, after the Supreme Court ruling last year in which certain limits were established.

“If the health situation allows it, we want to resume (the visits) throughout the year 2021 with full legal guarantees, taking into account the doctrine of the Supreme Court and the possible regulatory changes that may occur in this regard,” he indicated.

Payment and debt deferrals in the application

Gascón also announced this Tuesday that the agency will enable in its mobile application the request for debt deferrals and the payment of the same “in a single click”, while anticipating the launch of its new website in summer to have a only universal service.

The director of the Gascón Tax Agency has explained that the Treasury ‘app’ will adopt new functionalities since it was initially very oriented towards personal income tax, so that it will allow the payment of debts and the request for deferrals “in a single click” without the need of filling in sections, something that he believes will be “very successful” by being “totally revolutionary.”

Likewise, he has highlighted the consolidation of the integral territorial administrations after the opening of an administration of this type in Valencia, to which others in Galicia, Madrid and Andalusia will be added this year, which will provide telematic services to the entire national territory .

Thus, he has given as an example that if a query cannot be resolved with the system, pop-up screens may appear that offer a chat to interact with an official, and the last resort would be telephone assistance.

Regarding personal income tax, it has indicated that it will be possible to keep electronic books for personal income tax and VAT in order to download these books for the first time in Renta Web to automatically complement the income statement, also using ‘big data’ systems , while in relation to companies, the third party information service will be improved.

As for VAT, the VAT draft service will be extended to about 40,000 taxpayers, including large companies and more complex situations, out of a total group of about 60,000, after last year it was already offered to about 17,000, especially without large problematic. In turn, a draft VAT will be offered to around 600,000 landlords.

With regard to prevention, he has indicated that campaigns will be carried out to “purify” the census of inactive companies, so that the revocation of the NIF will be used and progress will be made in closing the registry, with notaries and registrars.

At this point, he considers early control important and as far as possible visits to taxpayers, something that he believes can be resumed depending on the evolution of the pandemic “throughout 2021”.
