The Court of Arbitration for Sport has rejected the request to suspend the Copa del Rey in a precautionary manner presented by Levante, according to several Catalan media. This decision comes after his complaint was rejected due to improper alignment in the first leg of the Copa del Rey round of 16 by the Competition Committee and his appeal was dismissed by the Appeals Committee.
Despite the denial of the precautionary suspension, the TAD will continue to investigate the complaint filed by the Levante.
The Levant filed yesterday the appeal before the Court of Arbitration for Sport (TAD) in which requested as a precautionary measure the suspension of the competition of the Copa del Rey until that appeal is resolved, as EFE has learned.
The Levante denounced to the RFEF for improper alignment of FC Barcelona, by aligning the youth squad Chumi who was sanctioned with the filial team, in the first leg of the round of 16 that both sides played.
The competition judge dismissed the complaint on the grounds that it had been submitted late, so the Levante filed an appeal with the Appeals Committee, which was dismissed on Monday night, but added that it was possible to appeal to the Court Administrative of Sport, within a period of fifteen days from the day after the notification is received.
This is what Levante has already done, which bases its appeal on the arbitration award issued by the CAS (CAS 2017 / A / 5001 & 5002) which confirms an earlier FIFA resolution in which it was established in a case of undue alignment that the deadline of prescription prevails over the brief preclusive term established by the competition regulations.
In addition to this award in the appeal, the Levante cites other resolutions of FIFA.
The eliminations of quarterfinals of the Copa del Rey start this same night, with the match between Getafe and Valencia.
