In a letter of October 26, to which Europa Press has had access, the prosecutor Javier Zaragoza has requested that the inadmissibility be agreed and "the filing of the proceedings" in view of the "manifest absence of circumstantial elements that prove that the facts that are they impute to him to the aforada can be constitutive of crime, declaring himself incompetent for the investigation relative to the remaining defendants ".
The association accuses Díaz Ayuso of allegedly "accepting the donation made by his parents of what was their family home, in order to remove it from any execution that could be agreed upon in the event of non-payment of the loan-guarantee."
The Prosecutor's Office has assured that the leader "neither had any relationship or participation in the activity of the company Infortécnica SL, nor did it benefit in any way from the credit-guarantee granted by Avalmadrid to this company, nor can it be considered a debtor in relation to the non-payment of that credit (which excludes the possibility of being considered the material author of the crime) ".
