The Supreme inadmits a complaint against Pablo Casado for talking about the contract of Ayuso's brother

On February 22, Paul Married entered the study of the COPE network in his last interview as leader of the Popular Party. There he expressed all his suspicions about the information he had about the brother of Isabel Díaz Ayuso, the collection of a commission that now investigates the Anticorruption Prosecutor and the role played in the contract by the president of the Community of Madrid. Four days later, an association filed a complaint against the then still deputy, accusing him of revealing confidential bank details of Tomás Díaz Ayuso. The supreme court He has just inadmissible this complaint: in any case the brother of the regional president would have to denounce him and, furthermore, the complaint does not reflect anything similar to a crime of revealing secrets.

That day, on the station's morning program, Casado stated that according to his information, Isabel Díaz Ayuso's brother had received a commission of 286,000 euros for a mask contract awarded by the regional administration to a friend of theirs. A contract revealed by elDiario.es in November last year. In the interview she stated that she had asked Ayuso for explanations, and launched an accusation in the form of a question: "When 700 people died a day, can you contract with your sister and receive 286,000 euros?"

That morning a storm raged that ended with Casado saying goodbye to politics in the Congress of Deputies A few days later. "I understand politics from the respect to the adversaries and the dedication to the companions", said the still deputy. Two days later, the Supreme found that he was still registered [dejó el escaño formalmente el 4 de abril] and the Prosecutor's Office requested that this complaint, filed by a supposed representative of the National Anticommunist Association for a crime of revealing secrets, be inadmissible: neither the complainants are affected, nor do they provide any criminal suspicion about Casado nor, finally, does the complainant prove be a representative of the association or what interest he would have in denouncing the crime.

Some arguments that the criminal chamber of the Supreme Court accepted a few days ago, before Pablo Casado left his seat in the lower house and, therefore, while he was still appraised. The car, with Juan Ramón Berdugo as rapporteur, rejects the complaint for various reasons of form, but also of substance. In the first place, because the crime of revealing secrets that this association denounces is a crime that has to be denounced, in any case, by the affected person: "They are not, therefore, in principle, public crimes or prosecuted ex officio," they recall. the judges. If someone should denounce Casado, in any case, it is Tomás Díaz Ayuso.

The complaint also did not specify what specific secret data Casado would have revealed in the interview where he responded to the accusations launched by Isabel Diaz Ayuso that the president's entourage had persecuted her in a "cruel" way. The judges say that the description of the facts is "excessively generic, to the point that, under the pretext of affirming that they are public and notorious facts, it is not even said what the secret data revealed or used by the accused, nor who supposedly access them, or what the use of them consisted of, much less what the damage caused to the owner of the data, who has not denounced, or to a third party, consisted of".

The Supreme Court does not even consider it proven that the man who filed the complaint in February on behalf of the National Anticommunist Association is, in fact, a legal representative of some kind of that association. The judges speak of the "lack of accreditation of the condition that the complainant attributes to himself, as a representative of an association whose interest in denouncing facts that he says are public and notorious is unknown" as yet another reason to reject the complaint, as the Prosecutor had requested.

This National Anticommunist Association, as this newspaper has been able to verify, is effectively registered in the National Registry of Associations of the Ministry of the Interior since February 2018, although it has no known public activity beyond its activity on different social networks such as Facebook or Twitter. In this last profile, for example, he announced the filing of the complaint, and combines numerous insults to members of the Government or the Popular Party with positive comments to several leaders of the far-right Vox party. It is registered as an association "referring to military issues", according to the Registry.

The complaint of this association is not the only legal action filed against Pablo Casado for these words about the contract revealed by elDiario.es, although this order from the Supreme Court marks the way to the rest of the complaints now that he has lost his capacity after leaving his seat . The Barcelona lawyer Esteban Gómez Rovira also denounced the then leader of the opposition before the Madrid courts without, for the moment, knowing the result, although this Supreme Court decision condemns any initiative of this style to failure.

The complaint has been processed in the Supreme Court while Pablo Casado's political career was coming to an end. The same day she was filed, Married convened its last National Board of Directors of the PP. On the first weekend of April, the Conservatives held the extraordinary congress in Seville that bid farewell to Casado and exalted Alberto Núñez Feijóo as their new leader.

Meanwhile, what the Anti-Corruption Prosecutor does investigate is the contract and the commission that Pablo Casado spoke about in that interview. The department headed by Alejandro Luzón announced the opening of an investigation that same February 22, four days later. Some proceedings on which no further data has emerged but which have led to an unprecedented confrontation between the Spanish Prosecutor's Office and the European Prosecutor's Office: the investigators of the community body have unsuccessfully demanded that their Spanish counterparts allow them to take charge of the investigation, understanding that these masks were paid for with European funds and that it is up to them to take over the reins of the cause.
