Supreme Court Judge Andrés Martínez Arrieta has prosecuted Constitutional Court magistrate Fernando Valdés for an alleged crime of mistreatment in the family and is taking the case to oral proceedings.

He has done it in an order for transformation into an abbreviated procedure (equivalent to the prosecution) in which he sees evidence of criminality against Valdés, arrested on August 11 after witnesses alerted some agents to a heated argument when the marriage was in the balcony of his home in Majadahonda (Madrid).
A decision that comes after he and his wife denied any physical or mental assault last week, a thesis that his daughter, who before the judge, has exonerated her father and denied that there was abuse.
The magistrate has transformed the proceedings into an abbreviated procedure, transferring it to the Prosecutor’s Office for a period of 10 days to request the opening of an oral trial by formulating an accusation document or the dismissal of the case.
