The Supreme Court begins the processing of the appeal of the Franco family against the exhumation



The Supreme Court has initiated the proceedings to resolve the appeal filed by the grandchildren of Francisco Franco against the Government's decision to continue the exhumation procedure of the mortal remains of the dictator of the Valley of the Fallen.

Specifically, the Fourth Section of the Contentious-Administrative Chamber of the High Court has opened a "precautionary measure" to examine the request of the Franco family to provisionally suspend the agreement adopted on November 8 by the Council. of Ministers while the appeal is resolved, have informed sources of the Supreme.

The Council of Ministers agreed on the continuation of the exhumation procedure for Franco's mortal remains in compliance with the 2007 law that recognizes and expands rights and establishes measures in favor of those who suffered persecution or violence during the civil war and the dictatorship.

The agreement orders the Minister of Justice to refer to the City of San Lorenzo de El Escorial (Madrid), where the Valley of the Fallen is located, the necessary project to carry out the exhumation.

As approved by the Executive, the technical services of National Heritage, in his capacity as patron of the Foundation of the Holy Cross of the Valley of the Fallen, will be responsible for drafting the project for processing in accordance with the provisions of land law and urban rehabilitation.

Likewise, the agreement establishes that the Ministry of Justice request the General Directorate of Public Health of the Ministry of Health, as an organ of the Autonomous Community of Madrid responsible for mortuary health, a non-binding report on the exhumation project to be issued in a maximum period of one month.
