The Prosecutor’s Office opens an investigation into the death from cancer of a woman from Burgos who did not get an in-person medical appointment in four months

The Superior Prosecutor’s Office of Castilla y León has agreed to initiate investigation proceedings regarding the case of a patient who died of cancer without having made a face-to-face appointment with her doctor head office in Espinosa de los Monteros (Burgos), according to sources from the El Defensor del Paciente Association.

After already this Monday the Minister of Health, Verónica Casado, spoke by phone with a sister of the victim and announced the opening of a reserved investigation, it is now the Superior Prosecutor’s Office of Castilla y León, at the request of the El Defensor Association of the Patient, which has decided to initiate investigation proceedings and refer them to the Burgos Prosecutor’s Office, as it is competent for their knowledge.

The Patient Ombudsman sent an email dated October 5 to this Community Prosecutor’s Office, requesting that the facts be investigated because he understood that they could constitute a crime of omission of the duty of care resulting in death. The family of the deceased has explained to elDiario.es that they did not rule out going to criminal proceedings and that they did not know the decision of the Prosecutor’s Office.
