José Ignacio Goirigolzarri will have to testify as a witness in BBVA's separate piece of the Villarejo case. The former CEO of BBVA and current president of Caixabank will go to the National High Court since the judge considers his intervention in the procedure "useful and necessary".

The magistrate recalls that, as stated by the Anti-Corruption Prosecutor's Office, from the analysis carried out of Cenyt's internal documentation on the TRAMPA/TRAPA project, it is necessary to listen to the person who was CEO of BBVA in 2004 and 2005 "as there are indications that he had access to the TRAMPA II report, as well as later to TRAMPA I and that, although he thought it could be criminal, he did not dare to comment on it with Francisco González».

Likewise, the order explains that the accusation (Luis del Rivero) had requested the statement as a witness of Carlos Torres, current president of BBVA, in relation to the information provided by the director of Communication of the entity, Pablo García Tobin, and, specifically, if you were aware of the existence of the Google Drive folder in which some documents were saved.

However, the judge considers that there is "no indication" of the executive's access to the aforementioned folder, with which "the petition lacks any usefulness and relevance."

In the same sense, the judge points out that from the analysis of the proceedings carried out to date and the study of the material that is involved in the proceedings, no evidence has been found that would allow it to be argued that Carlos Torres "issued any directive, instruction or order to hide documents that affect the procedure, so no link is detected, beyond their hierarchical position or in the entity, that justifies the appeal ».

On the other hand, the magistrate does agree to summon the entity's former Director of Communication, Javier Ayuso, as a witness, as requested by the private prosecution, in view of the new data collected since his previous statement in November 2019.
