The accused of the kidnapping of Aimar will not be able to approach the family or she would incur a crime of breach of precautionary measure

The judge has granted the restraining order requested by Aimar's parents against the accused of kidnapping the baby, according to the defense attorney. The defendant, Mireia CS, 24 years old, would incur a crime of breach of precautionary measure in case of breaching the prohibition to approach the Durango family within 500 meters. The defense has already announced that it will not appeal this decision because they do not want to "make the child's parents suffer more".

For her part, Mireia has been hospitalized since Tuesday in the Psychiatric Unit of the Basurto hospital, curiously the same one where the abduction took place, according to her lawyer. The woman had presented herself at night in the ER, but she had to wait for her to free up a room in the Escuza ward for mental illness until she was assigned a bed.

The young woman was released provisionally and without any precautionary measure last Saturday after acknowledging before the duty judge that she took Aimar from her mother's arms, disguised as a health worker with the excuse of doing a hearing test. According to what she confessed before the Ertzaintza and in court, she had become pregnant last February, but after a month and a half she suffered a miscarriage. However, she kept it a secret and continued to pretend that she was pregnant in order to receive the same protective treatment that her environment had provided. Thus, she bought clothes and all the trousseau for the girl she was supposedly expecting and she even showed false ultrasounds and a primer.

According to this idea, she was leaving accounts at the end of last September, but she was delaying the date until she was sure that they were going to cause her labor. When her boyfriend and her family began to doubt that she was really pregnant, she Mireia ran away from home and planned her kidnapping. She put on a white sanitary suit and entered the maternity area, where access controls are lax. She tried it up to three previous times in other rooms and on the fourth she took Aimar. To get out of the medical complex, she put him in a bag from the BM supermarket. It was around half past nine last Wednesday night.

As she did not want to return home and regretted being "alone in the most delicate moment of her life", some friends offered her to spend the night with them at their home on Fika Street, believing that the baby was hers. They even took photos and videos of him with the child and sent them to acquaintances. The next morning, already aware of what she had done, Mireia picked up the newborn, entered a doorway and left him on the doormat of an apartment that she chose at random in the same neighborhood of Santutxu.

Two hours later, she was arrested by the Ertzaintza in the Zorroza neighborhood. According to what she has stated, she walked there and asked a friend to call the police to arrange her delivery. After spending two days in the dungeons of the central police station of the Ertzaintza in Deusto, the detainee was brought to justice and, by judicial decision, she was released without precautionary measures.

The court's forensic experts in psychiatry did not detect an acute psychotic outbreak in her, although they did detect a slight delay that could affect her faculties, but which will have to be assessed in future interviews about her responsibility. The magistrate understood that there was no risk of flight, nor of destruction of evidence or criminal reiteration when the lie that had led her to steal the baby decayed before her partner and her family. The young woman promised at that time to voluntarily enter a psychiatric center, although for this it is necessary for a specialist to determine so.
