The judge closes the instruction of the 'Diana Quer case' | Society



The judge concludes the investigation into the death of Diana Quer 14 months after José Enrique Abuín Gey, aka The gum, reveal the place where he had hidden the body of the 18-year-old Madrilenian girl. If the terms of justice are met, at the end of the summer or, at the latest, before the end of 2020, the man who admitted killing her (Abuin does not admit killing her) will sit on the bench of the accused. The trial will be in the so-called Wedding Hall of the courts of Santiago, before a popular jury. And although the tests carried out have not been determinant in some aspects such as the possible sexual aggression, the neighbor of Rianxo he will possibly come to trial with all the burden of the alleged crimes that were attributed to him from the beginning: murder or homicide; illegal detention and against sexual freedom.

At the beginning of January the head of the Court of First Instance and Instruction 1 of Ribeira, Felix Isaac Alonso, still lacked a couple of reports to tie his inquiries. They were a calligraphic test of El Chicle and the conclusions of the Civil Guard about the reconstruction of the night of the crime that took place in June 2018. That big test was carried out with the participation of the researcher, who took the agents a route of more than 40 kilometers, inside and outside the region. As reported today by the Superior Court of Xustiza de Galicia (TSXG), now the results of these tests are already in the hands of the judge and he considers that there are no investigative measures to be carried out, so the case is prepared for the phase of opening of oral trial.

At this point has not transcended the success that may have come to have the second coroner, José Blanco Pampín, who gave the family of the deceased girl to review the exhaustive report prepared by his colleagues at the Institute of Legal Medicine of Galicia (Imelga ). The tests carried out on the corpse, including the skeletonization and the study of the bones by one of the best forensic anthropologists in Spain, Fernando Serrulla, were able to determine the strangulation but did not show or rule out sexual assault or rape. The body had spent too much time, 500 days, submerged conscientiously in a well and any presumed vestige had been erased by the deterioration of the corpse and fresh water. Although the judge considered the first autopsy sufficient, last September the Provincial Court of A Coruña accepted that revision without a corpse, only on paper, by Blanco Pampín, head of the Imelga in Santiago well known for other media cases such as death of Asunta Basterra and the case of Ramón Sampedro.

The only one accused of the kidnapping and death of Diana Quer remains in custody since January 1, 2018, after confessing the authorship of the death but not the sexual offense. Abuín assured first that it had been an accidental accident, and after the months, when the result of the autopsy was known, he changed this version to that of an "involuntary" strangulation.

After months of inquiries about the whereabouts of Diana Quer, the case was precipitated in December 2017, when a young woman from Boiro (A Coruña) reported being the victim of an attempted kidnapping. The description of the man and the car that she and other witnesses contributed led to Enrique Abuín, who was already one of the main suspects of the disappearance of Quer for a year.

The Chewing Gum was stopped on December 29, 2017 and, two days later, at the end of the year, it took the investigators to the old warehouse that had been a soft drink factory and a furniture warehouse a few meters from their parents' house. place of Asados ​​(Rianxo). Since then, he remains in jail awaiting trial, although already in prison he was sentenced to two and a half years for participating as a mail in an operation of drug traffickers.

In a ruling, the judge in the Quer case now communicates to the parties the closing of the investigation, so that they "insist on what they deem appropriate" with respect to the opening of the oral trial and formulate their briefs on provisional findings. The case will then be transferred to the Provincial Court, and the Sixth Section, based in Santiago, will convene the preliminary hearing that includes the Jury Act with the aim of Abuín reaching the bench before the end of 2019.
