The Court of Lleida has sentenced two men who raped a young woman in Vielha (Lleida) to four years and six months in prison. The court considers that there was no sexual assault, as requested by the prosecution, which requested 15 years in prison, because although she refused and asked the aggressors to stop, she did not shout or resist.
The Court gives full truth to the story of the victim and considers proven that the girl ended up being raped in the back of a nightclub, by two men of 23 and 19 years old, uncle and nephew. The young woman knew one of them.
After meeting them in a bar, he continued with them the night, they went to a disco, they continued drinking and the young woman went out to the back with one of them. There the young man kissed her, according to the sentence, she "surrounded him with her legs" and he took her to a part a little farther away and "put her against the wall". Then she lowered her pants and underwear and penetrated her "even though the girl told him repeatedly and crying that she did not". Then the young man's nephew arrived, who also raped her and forced her to fellate him.
Later, one of them offered to take her home and ended up accompanying her to a bridge in front of the hospital, where she stayed crying until she went to the health center and explained what happened. "The victim found herself unable to react in any other way, being practically paralyzed, without shouting or resisting, beyond, of course, continuing to express her refusal to what she was being subjected to, which made unnecessary, repeatedly, the use of violence or intimidation to break their will, "the court concludes.
