According to the indictment, to which Efe has had access, the events took place at dawn on October 3, 2010 in La Oca street in the neighborhood of Carabanchel, when two police officers requested the documentation of a man of Ecuadorian nationality who refused to Present and berate the agents, as did the four people who accompanied him, all of them Ecuadorians.

In the area was Tohil Delgado, who "took his mobile phone with which he tried to record the scene while screaming at the agents: 'You son of a bitch, you are shits'".

With the reinforcement agents in place, one of the two police officers involved in the incident approached Tohil Delgado, who was standing next to the guarded wall, hit him and threw him to the ground, which caused injuries to his thigh. and in the face.

The Prosecutor's Office accuses the five Ecuadorians of attempted crimes and attempted robbery, as well as lack of injuries and against public order, for which it requests penalties ranging from one to two years in prison. Tohil Delgado only charges a lack of injuries as he does with a policeman.

However, Delgado accuses the agents of being the ones who beat him and claims to have videos that support his version.
