The conservative and progressive sectors of the Public Prosecutor’s Office are immersed in a strong confrontation regarding the report in which the Supreme Court prosecutor, Luis Navajas, asked to reject the twenty complaints filed against the Government for his management of COVID-19 and his statements affirming that two fellow prosecutors from the High Court “ideologically contaminated” they tried to “influence” him on how he had to act in relation to the complaints. Navajas is the ‘number two’ of the State Attorney General, Dolores Delgado.
The Attorney General’s Office opens an internal investigation into the alleged pressure on Navajas in the complaints against the Government
The Association of Prosecutors (AF), majority and conservative, considers that the latest events and the “attacks” of Navajas have plunged the Prosecutor’s career into “the greatest discredit” in “forty years” and ask Delgado to abandon his “Complicit silence” and act against him. “We consider intolerable that the State Attorney General has not given a forceful and immediate response to this action by the lieutenant prosecutor, which protects the prosecutors affected and prevents those who faithfully perform their duties from being put into question,” the association in a statement released Thursday.
In another statement also released this Thursday, the Progressive Union of Prosecutors (UPF) asks “to put an end to the tension” in the face of the “complicated” situation that the institution is going through and says that the “values” represented by the Prosecutor’s Office “must position it by above any personal or partisan interest ”. UPF maintains that recent events must find an “internal solution” through the established channels and that, to this end, the procedure for this has already been launched, which “demonstrates the functioning of the institution”.
What the chief prosecutor of the Fiscal Inspection, Fausto Cartagena, an independent position from the attorney general, is investigating are the alleged pressures revealed by Navajas. This Monday, in an interview on Onda Cero, the Supreme Prosecutor’s lieutenant assured that two fellow prosecutors from the High Court “ideologically contaminated” they tried to “influence” him on how he had to act in relation to the complaints, which led to the opening of an internal investigation at the Prosecutor’s Office to analyze these alleged pressures.
Navajas specifically cited Consuelo Madrigal, who was State Attorney General between 2014 and 2016, appointed by Mariano Rajoy, as one of the people who, along with another prosecutor who did not identify, went to his office to “advise and influence” on how should address the twenty complaints filed. Although she did not name her, the other prosecutor is Fidel Cadena, chief prosecutor of the Supreme Court. Madrigal and Cadena were two of the four prosecutors who represented the Public Ministry in the trial of the procés.
In its statement, the Association of Prosecutors criticizes the “disqualifications” and the “lack of consideration for his colleagues” of the Supreme Attorney’s lieutenant and comes out in defense of Madrigal and Cadena – although it does not cite them – ensuring that the alleged pressure on Navajas ” they had never ”been denounced by him and that they do not have“ the least objective corroboration ”.
Although it does not cite him either, the statement also refers to the prosecutor in the Villarejo Ignacio Stampa case, against whom Vox has sued for the alleged “intimate” relationship – of which there is no evidence – that he maintained with one of Podemos’ lawyers in that cause, Marta Flor. The Supreme Prosecutor’s lieutenant assured in interviews that he would have “separated” him and described that alleged relationship as “scandalous.” The Association of Prosecutors ugly Navajas that attributed to this prosecutor leaks of the content of the court cases and also says that, with his statements, he attacked and injured his honor and presumption of innocence.
“We understand that in forty years there has never been a situation like the current one, with the greatest discredit of the Fiscal Career, which was born with the appointment, without interruption, of the PSOE deputy and Minister of Justice, as attorney general, and it reaches the present time, in which we have had to suffer the attacks that from the figure of the ‘number two’ of the race have been poured on the companions, before the complicit silence of Delgado ”, concludes the Association of Prosecutors.
