The National Commission of Markets and Competition (CNMC) has decided to withdraw the proposal to circulate to determine the remuneration for the regulated activity of natural gas distribution that was in process and submit a new text to public consultation.
In a statement, the body chaired by José María Marín Quemada said that after examining the proposals received and the objectives pursued, "and for the sake of greater gradualness and proportionality of the remuneration", a modification of the methodology that went to public consultation is made . The reverse of the CNMC has been advanced by Cinco Días.
The new proposal, which according to Competition maintains the current model, recalculating the base of the remuneration and introducing a gradual factor in the adjustment, will be subject to a hearing process next week for a period of 15 days. The new text can be consulted "in the coming days".
The CNMC recalls that it submitted to public consultation a first proposal that, while retaining the principles established in the current remuneration model (base remuneration to which an income from market capture is added), reviewed the aforementioned base remuneration with the audited value of the assets , as was already done in 2002. This first hearing proceeding lasted from July 10 to August 9.
In that period, the regulator received allegations from gas distribution companies, gas marketers, autonomous communities, unions, gas consumers, as well as from different types of associations and investors.
The agency, in accordance with the functions granted to it by the Government earlier this year, launched its proposal for 14 energy circulars to approve them before this exercise expires.
In this way, the circular that affects the remuneration for gas distribution networks for the period 2021-2026 thus returns practically at the beginning of its process, with the aim of seeing if it will be possible to give it time to move it forward before the conclusion of this year.
The law establishes that these regulations should be approved before the deadline, on December 31, is faced with the risk of being able to extend the current remuneration.
However, sources from the Ministry for Energy Transition pointed out that, despite the fact that Royal Decree Law 1/2019 establishes that all remuneration methodologies and also of electricity and gas tolls have to be established before December 31, no There will be no problem in that those of gas are not approved before the end of this year, since the new regulatory period takes effect in 2021.
The same sources indicated that the effect that they are approved is "fundamental" only in the case of the electricity sector, whose new regulatory period goes from 2020 to 2025.
17.8% initial ax
In its initial proposal to circulate launched in July, the CNMC had raised an 'ax' of 17.8% for the natural gas distribution activity - which almost 70% corresponds to Naturgy but also carried out by other companies such as Madrileña Red Gas, Nortegas or Redexis, among others- for the period 2021-2026.
With the current regulation, the remuneration for the distribution activity for the gas sector for the period 2021-2026 would amount to a total of 8.520 million euros, while the CNMC raised in that first proposal, 'lying' today, a cut of the 17.8%, to 6,990 million.
