The Plenary Session of the General Council of the Judiciary (CGPJ) has approved the bases that will govern the call and the selective process for the provision of 16 judicial positions, including those corresponding to the presidency of the Superior Court of Justice of the Canary Islands (TSJC).
He has also authorized the corresponding to the presidency of the Second Chamber of the Supreme Court, whose current owner, Manuel Marchena Gómez, will fulfill his five-year term next October.
As reported by the governing body of the judges in a statement, the Plenary has also approved the bases for convening another three positions of the high court: one of magistrate in the Criminal Chamber, corresponding to the general shift; one of magistrate in the Contentious-Administrative Room, also of the general shift; and one in the Sala de los Social, of jurists' turn.
These three places will be vacant due to the retirement of magistrates Alberto Jorge Barreiro (Criminal), Juan Carlos Trillo Alonso (Contentious-Administrative) and Miguel Ángel Luelmo Millán (Social).
Precisely, Luelmo Millán occupied a specialist position, but the Plenary Session of the CGPJ has agreed that the call be made by the jurists 'turn to regularize the composition of the Chamber, currently composed of five magistrates of the general shift, six of the specialists' shift and two of jurists' turn.
The rest of the approved call bases correspond to the presidencies of four other Superior Courts of Justice (TSJ) – in addition to the Canary Islands they are Aragon, Asturias, Extremadura and Navarra -; of the Contentious-Administrative Chamber of the TSJ of Galicia; of the Social Rooms of the TSJ of Galicia and Catalonia; and of four Hearings Provincials: those of Vizcaya, Pontevedra, Segovia and Tarragona.
The CGPJ emphasizes that with the approval of the bases of the call, it complies with the provisions of the reform of article 326.2 of the Organic Law of the Judiciary, on the provision of the positions of magistrates of the Supreme Court and of governmental positions, that is, of the presidencies of judicial organs.
Said article establishes that "an open call will be made that will be published in the Official State Gazette, whose bases, approved by the Plenary, will clearly and separately establish each of the merits that will be taken into consideration, differentiating the aptitudes of jurisdictional excellence of the governors, and the common merits of the specific ones for a certain position ".
