The Central Electoral Board (JEC) has agreed on Friday that the ERC leader, Oriol Junqueras, sentenced to thirteen years in prison for crimes of sedition and embezzlement, may not be a candidate in the 10N elections for being "ineligible", even if there is Your disqualification penalty has been postponed.
The JEC argues that, in accordance with article 6 of the Organic Law of the General Electoral Regime (LOREG), the Catalan political leader is ineligible for being condemned with a final sentence and thus resolves the request that ERC sent him Thursday to Junqueras to be reinstated as a candidate for generals.
"It is not appropriate to agree to the request," says the Board.
The defense of Junqueras informed on Thursday of the presentation of an appeal before the Supreme Court to access freedom and another before the Central Electoral Board to compete in Sunday's elections.
Junqueras considered that he had the right to be a candidate after the Supreme postponed the penalty of absolute disqualification with which he was also sentenced in the case of "procés", pending the EU Court of Justice to resolve the question referred for a preliminary ruling on the scope of the immunity of Junqueras as a MEP.
The Electoral Board has already said no and the Supreme Court has given the parties three days in the "procés" case – the Prosecutor's Office, the State Advocacy and Vox – to rule on the request for freedom.
