Pollo Carvajal exhausts his options to avoid being extradited


The former Venezuelan general Hugo Armando ‘el Pollo’ Carvajal little by little he runs out of weapons to avoid his extradition to the United States. The Criminal Chamber of the National Court has ratified this Friday its decision to declare “sufficient” the guarantee offered by the United States on life imprisonment.

In a car notified today and against which there is no longer an appeal, the third section of the Criminal Law rejects the appeal filed by the former head of Venezuelan Intelligence against his decision to accept those guarantees in relation to the life sentence that may be imposed on him for the drug trafficking crimes for which he is claimed.

The Chamber also agrees to communicate the order “for the purposes of the record” to the Subdirectorate General for International Legal Cooperation and Interpol, as there is already a agreement of the Council of Ministers authorizing the extradition May 3, 2020.

By rejecting this last resort, which in principle was the last obstacle to the surrender of the former general, the magistrates argue that the allegations of Carvajal’s defense “do not distort the reasoning of the Court on the basis of which the guarantee that the authorities of the United States of America provide through its Embassy is declared sufficient ”.

For the Chamber, the guarantee provided by the North American country “It is sufficient in order to prevent life imprisonment from being an inhuman penalty, from the moment in which by way of appeal or by way of grace measure is not unfailingly for life, that is, not contrary to the purpose of reintegration proclaimed by our Constitution ”.

The Court notes that the diplomatic guarantee is mandatory and that it is the responsibility of the Government and international organizations to sanction any lack of commitment between States.

The third section, chaired by the magistrate Alfonso Guevara, On October 22, he suspended the extradition of the former Venezuelan general when it was already going to be executed, when noting that it was still necessary to ask the United States for these guarantees.
