The Provincial Court of Madrid has rejected the appeal presented by the former mayor of O Grove José Alfredo Bea Gondar against the publishing house Libros del KO and the journalist Nacho Carretero for the content of the book "Fariña" and has ordered him to pay the costs of the process.
In this way, the editors and the author of the book on Galician drug trafficking record another judicial victory against the former mayor, who sued them for an alleged violation of their right to honor for the mentions made to him in the book and intended a compensation of 500,000 euros.
Bea Gondar got at the time that the work remained kidnapped for three and a half months by decision of the judge of Collado Villalba (Madrid) Alejandra Fontana, but finally the Audience of Madrid lifted that kidnapping and the replacement of that judge dismissed the demand.
The former mayor decided to resort to the Provincial Court, which in a sentence to which Efe has had access has rejected his appeal and has again ordered him to pay the costs of the procedure.
As the judge of Collado Villalba did at the time, the Provincial Court emphasizes that the facts that the book relates in relation to Bea Gondar are "truthful", the result of the author's research work and do not cross the limits of the right to information, which in this case prevails over that of the appellant's honor.
Nor does the court appreciate that Carretero's statements in several interviews in which he referred to Bea Gondar as "drug trafficker" did not exceed "the informational purpose" and, moreover, in this case, they are protected by freedom of expression.
Bea Gondar can still appeal in cassation before the Supreme Court.
