Court 15 in Madrid has rejected the precautionary measures that Real Madrid, FC Barcelona and Athletic de Bilbao presented against the agreement reached between La Liga and the CVC fund, ratified by a large majority by the clubs last December. The judge refuses to apply the precautionary measures and freeze the agreement since, she explains in an order, "it would suppose the paralysis of effects already initiated or executed, accepting and superimposing the criteria of a minority against the election carried out and consented by the majority ".
LaLiga saves the sale of part of its business to CVC with the vote against Real Madrid and Barcelona
The agreement between the body led by Javier Tebas and the CVC Capital Partners fund was approved by the majority of the clubs in an extraordinary meeting last December, with 37 teams in favor of the total of 42. The agreement includes a disbursement of 1,994 million euros by the fund in different payments, in exchange for more than 8% of the profits generated by the marketing of competition for the next 50 years. This includes audiovisual and digital rights and other ramifications of the business.
Real Madrid, FC Barcelona and Athletic went to the Madrid courts and requested the precautionary stay of the agreement adopted by the La Liga assembly, a measure rejected by the magistrate María Vilma del Castillo. The judge understands that the three clubs support a very minority option on what was agreed in the La Liga assembly and that, in addition, "the principle of minimal interference must prevail until the final decision" when social matters are settled. In other words, we will have to wait for a ruling on the merits of the matter.
