There is already a draft agreement to remove 300,000 interns from the different Public administrations. The Ministry of Public Function and the unions will meet this afternoon at the negotiating table – of which the autonomous communities are also part – to carry out a pact to launch a massive opposition process, according to sources close to the talks.
“If in three years an administration does not stabilize a structural position, it would lose it,” said the minister months ago. Miquel Iceta. Brussels has been pulling Spain’s ears repeatedly due to the high temporality of the public sector, already higher than in the private sector, with rates of more than 30% of casualties, especially in health and education. The goal is for it to drop below 8% –A goal that should have been met by 2020, according to the agreement signed by the previous Executive with the unions in 2018–.
The document, to which ABC has had access, implements “a new stabilization process, in terms similar to those provided for in the 2017 and 2018 agreements.” And adds: “This process will affect all positions of a structural nature, budgeted, temporarily and uninterruptedly occupied for at least three years prior to December 31, 2020 and that have not been included in the stabilization processes provided for in the Agreements for the Improvement of Public Employment of the years 2017 and 2018 ».
All opposition processes must be “Resolved” before December 31, 2024. A term that in no case will be extendable, so that by that date the positions that enter the stabilization process must become civil servants.
One of the most controversial points was in the score that will be assigned, for example, to the previous experience of the interns to be able to ‘stay’ with their place. It has been drawn up as follows, at 40% by weight: «The processes will be developed through competition-opposition, with an assessment of the competition phase of 40%, in which experience will be taken into account mainly in the body, scale, category or equivalent in question within the framework of the collective bargaining established in art. 37.1 c) del Trebep ».
Likewise, the final draft provides that, in the event that an intern does not pass the selection process,
He will be compensated with twenty days of his fixed remuneration per year of service, the periods of less than one year being prorated by months, up to a maximum of twelve monthly payments. Of course, always from the date of effective termination in his interim position. In the case of temporary labor personnel, compensation will consist of “the difference between the maximum of twenty days and the compensation that they should receive for the termination of their contract, prorated by months for periods of less than one year, up to a maximum of twelve monthly payments. ». In any case, Those who do not appear for the procedure will not have the right to be compensated.
To monitor that all the terms of the pact are fulfilled, the ministry and the unions create a monitoring commission “With the commitment to be especially vigilant with the correct development of the same in all its sections, especially in the stabilization processes and what is contemplated in the modification of the Trebep”.
In general terms, the agreement establishes that the vacancies in which interim personnel are appointed “must be filled as soon as possible by any of the provision mechanisms provided for in the regulations of each Public administration». And in this last document, with respect to the previous ones, it has been added that «for all the selection processes, measures should be articulated to favor that certain local entities, especially in those cases in which the management capacity is more limited, entrust the material management of the selection of its civil servant career or permanent work staff to the provincial councils, town councils, island councils, supra-municipal entities or equivalent bodies in the single-province autonomous communities.
