Feijóo proposes to remove from Congress the reform to eliminate the word "diminished" from the Constitution

Two months after the President of the Government, Pedro Sánchez, formally proposed an agreement to reform article 49 of the Constitution to eliminate the word "diminished" from the text, the president of the PP, Alberto Núñez Feijóo, has promised before the Spanish Committee of Representatives of People with Disabilities (CERMI) to support the modification. Yes, with conditions. The first, that the Government desist from the proposal that is already being processed in Congress (with the rejection of PP and Vox). Second, take the negotiation out of Parliament and form a table "with the PSOE and CERMI" to close a new draft. And the third, that no group propose a referendum. Something that does not depend exclusively on Sánchez and Feijóo.

This was announced by Feijóo himself this Thursday after a long meeting with Cermi representatives. "There is no doubt, no nuance, no limit to accredit the maximum interest of the PP to update 49 of the Constitution to discard the term" diminished "and incorporate" disability ", he has said in statements to the media. "There is no doubt about it. I transmitted it to the president and I have transmitted it to CERMI”, he added.

For Feijóo, the measure is "timely, appropriate, justified." "And we must do it," he added. Last September 2021, however, the PP and Vox joined their votes in Congress to try to return to the Government the text that the Council of Ministers approved in May of that same year. The very organization with which Feijóo met today applauded the drafting of the new articlesbut the current general secretary of the PP, Cuca Gamarra, then justified the No of the PP in what the "opening in channel" of the Constitution would mean, "a risk that has not been measured" sufficiently due to the parliamentary "dependence" of the Executive "on the independence parties", added the parliamentary spokeswoman.

PP and Vox were left alone and the Government's proposal passed the filter, although it has been sleeping since then in the processing of Congress. This reform a reinforced majority of three-fifths of Congress and Senate. And the risk of the referendum exists because any change in the Constitution must be consulted with the Spanish people if so requested by at least 35 deputies, a number that could be reached in multiple ways with the current parliamentary arithmetic.

Table outside the Congress

Feijóo has insisted on this point. "A constitutional referendum to that effect must be avoided," he said.

But, in addition, the leader of the PP wants to take the reform out of Congress and close it alone with the PSOE. "Our proposal is very clear: before the end of June, set up a table between the CERMI, the PSOE, the Government and the PP to advance the final text of the reform of 49", he pointed out. Later, it would be sent to the Council of State for the mandatory report, "hopefully it arrives without modifications and we will carry out the constitutional reform with the rest of the parties," he concluded.

That is, propose to the rest of the groups a precooked menu previously with the PSOE. Recover bipartisanship, as in the 2011 reform to introduce debt payment as a constitutional duty or in the 1992 reform to adapt it to Maastricht. The difference is that now both groups do not exceed 50% of the votes nor do they add the necessary deputies without the support of others.

For Feijóo, this "is the most honest way of relating, of making transparent the will of the parties." The leader of the PP has been "convinced that there will be no parties that use disability to politicize."
