Evictions grow by 12.2% in the Canary Islands - La Provincia


Evictions grew by 12.2% inCanary Islandsin the second quarter of the year, with respect to the same period of the previous year, up to a total of 1,110, while over the previous quarter, the increase is 24.7%, according to data from theGeneral Council of the Judiciary (CGPJ)made public this Monday.

Of them, 334 were performed byforeclosure(-4%), 716 for theUrban lease law(+ 23%) and 60 due to other causes (+ 1.7%).

Atset of Spain, the number of launches in the second quarter of 2018 was 17,152, a figure that, after four quarters of year-on-year reductions, reflects an increase of 1.7% compared to the same period of 2017.

On the contrary,foreclosuresInitiates decreased by 6.2%.

Heincrease in launches practicedis the consequence of the 6.1% increase experienced by the derivatives of theLaw of Urban Leases (LAU).

During the analyzed period, there were 10,491 launches due to non-payment of rent, which in percentage terms represents 61.2% of the totalreleases of the quarter.

In contrast, the launches derived from foreclosures were 5,672 (33.1% of the total), a figure that represents a decrease of 8.5%. The remaining 989 launches (representing 5.7% of the total) are derived from other causes.

By province, Catalonia (with 4,170, 24.3 percent of the national total) has been, by far, theAutonomous communityin which more launches were made in the second quarter of 2018, followed byAndalusia(with 2.718),Valencian Community(with 2,245) andMadrid, with 1,878.

As in the last quarter,Galiciait has shown a year-on-year reduction of over 50%, with security due to the strike of officials.

Attending only to the launches as a result of procedures derived from theUrban lease law, in the first place appears Catalonia, with 2.589 (24.7% of the national total); followed byMadrid, with 1,467; Andalusia, with 1,419; and theValencian Community,with 1.212.

As for the derivatives offoreclosures, the classification is headed by Catalonia, with 1,181; followed by Andalusia, with 1,132; Valencian Community, with 959; and Murcia, with 528.

Hereportit also includes the number of launches requested to the common services of notifications and embargoes, although with the warning that this service does not exist in all judicial parties, so the data allows to measure the evolution, but does not indicate the absolute values.

In addition, the fact that a launch is requested to the common service does not mean that it has been executed.

With these premises, the available data show that the number of launches requested to the common services in the second quarter of 2018 was 20,526, 7.2% more than in the second quarter of 2017. Of these, 12,398 ended with positive compliance , which represents an interannual increase of 4%.

Foreclosures are reduced by 6.2%

The report prepared by the Statistics Section also offers the data related to foreclosures filed.

In the period under analysis, they totaled 7,216. Although this figure indicates a decrease of 6.2% with respect to the same quarter of 2017, there has been a slowdown in the decrease in foreclosures, since in the seven previous quarters the reductions ranged between 26% and 46, 5%.

By Autonomous Communities, it was in Andalusia that a greater number of foreclosures were initiated (1,467, 20.3 percent of the national total); followed by Catalonia (with 1.311); Valencian Community (with 954); Murcia (with 631); and Madrid, with 627.

According to the data analyzed by the Statistics Section, the competitions presented in the second quarter of 2018 – both those presented in the commercial courts and those presented by natural persons (non-businessmen) in the courts of first instance and in the courts of first instance and instruction- totaled a total of 2,416, which represents an increase of 20.7% over the same quarter of 2017.

Those corresponding to natural persons (859) experienced an increase of 48.1% compared to the same period of the previous year. Catalonia was the Autonomous Community with the most competitions presented (284, representing 33.1% of the national total). Behind, the Valencian Community, with 143; Madrid, with 139; and Andalusia, with 169.

Less pronounced was the increase (of 9.6%) of the contests presented in the mercantile courts, which totaled 1,557.

Again, it was in Catalonia where a greater number was registered: 374, which represents 24% of the national total. They were followed by Madrid, with 267; the Valencian Community, with 219; and Andalusia, with 169.

On the other hand, the number of contests declared in the second quarter of 2018 in the Commercial Courts was 920, 4.9% less than in the same period of the previous year. To this figure are added the 434 contests declared and concluded under Article 176 bis 4 of the Bankruptcy Law.

In the same period, a total of 184 tenders reached the agreement stage, while the 840 liquidation phase began, 4.7% more than in the second quarter of 2017.

Regarding the files of Article 64 of the Bankruptcy Law, regarding the substantial modification of collective work conditions (ERE), 109 files have been submitted, 7.6% less than in the same quarter of the previous year.

In addition, between March and June of this year there have been 25,785 claims for dismissal, 0.3% less than in the second quarter of 2017. Madrid (with 4,772, 18.5% of the national total) was the Autonomous Community in the one that presented more demands of this type.

They were followed by Catalonia (4,496, 17.4% of the national total) and Andalusia, with 3,907, representing 15.2% of those presented throughout Spain.

The number of claims for quantity claims registered in social courts amounted to 33,573, 4.8% more than those filed in the second quarter of 2017. Of these, 6,219 took place in Madrid; 5,298 in Andalusia and 3,661 in Catalonia.

The report also includes data on the payment procedures submitted in the second quarter of 2018 in the Courts of First Instance and First Instance and Instruction, which amounted to 155,991, which represents a year-on-year increase of 25.4%.

These procedures – which serve to claim liquid, determined, due and due debts, and include the amounts due for common expenses of communities of owners of urban buildings – increased in all the higher courts of justice.
