The
discontinuous fixed will also be able to access the subsidy for people over 52 years of age
if they are unemployed and meet the rest of the requirements. The Council of Ministers has approved today Tuesday a Royal Decree-law with a set of measures to avoid situations of lack of protection in vulnerable groups. In this line, the access of workers with discontinuous fixed contracts to unemployment benefits of 463.2 euros per month is guaranteed, which is collected until retirement under the same conditions and with the same rights that apply to the rest of the workers of the General Social Security Scheme protected by the contingency of unemployment. Until now, one of the requirements to access this subsidy was not to have the status of permanent discontinuous worker.

For this, the Government has introduced a modification in the consolidated text of the General Law of Social Security approved by Royal Legislative Decree 8/2015, of October 30. From Labor they recall that this measure means complying with the labor reform approved last December and they quantify the number of workers who will benefit at 18,000 workers per month.

“Thus, the promotion of indefinite hiring and, in particular, of the discontinuous fixed contract, will be compatible with unemployment assistance protection for current beneficiaries of the subsidy for unemployed people over 52 years of age, who, otherwise, would see their subsidies extinguished. as soon as they agreed to a discontinuous permanent employment relationship, ”according to Labor.

"It will make it possible to lay solid foundations for employment stability to take hold in sectors with stationary or cyclical activities," they add from the department led by Yolanda Díaz.
